Dispute resolution and arbitration This warranty includes an arbitration provision.
Main points - Most disputes between you and LG that arise from or relate to the product or this limited warranty must be resolved by binding arbitration, not in court. - You and LG waive the right to a jury trial and to participate in a class action. - An individual action may be brought in small claims court, but not as a class or representative action.
Before arbitration If you want to start arbitration, you must first send LG a written notice at least 30 days in advance. The notice must include: - your name - address - telephone number - the product involved - a description of the claim - the relief you are seeking
Send the notice to: LG Electronics USA, Inc. Attn: Legal Department- Arbitration 111 Sylvan Avenue, Englewood Cliffs, NJ 07632
LG and you then have 30 days to try to resolve the dispute in good faith before arbitration starts.
Arbitration process - Arbitration is handled by the American Arbitration Association (AAA). - It is heard by a single arbitrator under the AAA Consumer Arbitration Rules in effect when arbitration begins. - If the AAA rules conflict with this warranty section, this warranty section controls. - The Federal Arbitration Act governs this arbitration provision. - Judgment on the arbitrator’s award may be entered in a court with proper jurisdiction. - The arbitrator decides all issues except the scope and enforceability of the arbitration provision, and whether a dispute is arbitrable; those issues are for the court.
Fees, hearing, and location - You do not need to pay a fee to begin arbitration. - LG will promptly pay AAA filing fees unless you seek more than $25,000 in damages; after that, AAA rules control fee payment. - LG pays AAA filing, administration, and arbitrator fees for qualifying arbitrations under the rules stated here. - If you prevail, LG will pay reasonable attorneys’ fees and expenses, considering factors such as the purchase amount and claim amount. - If the arbitrator finds your claim or requested relief frivolous or brought for an improper purpose, fee payment follows the AAA rules and you agree to reimburse LG for amounts LG paid that are otherwise your responsibility. - If LG prevails, LG waives any right to seek attorneys’ fees and expenses from you, except as otherwise provided. - If your claim is $25,000 or less, you may choose a document-only arbitration, a telephonic hearing, or an in-person hearing under AAA rules. - If your claim exceeds $25,000, the AAA rules determine whether a hearing is available. - In-person hearings are held in the federal judicial district where you reside unless you both agree otherwise or agree to a telephonic arbitration.
How to opt out You may opt out of this dispute resolution procedure.
To opt out, you must notify LG no later than 30 calendar days from the date of the first consumer purchaser’s purchase by either: - emailing optout@lge.com with the subject line “Arbitration Opt Out”, or - calling 1-800-980-2973
Include: - your name and address - the purchase date - the product model name or model number - the serial number
The serial number can be found on the product or online using LG’s model and serial number lookup page.
You must opt out by email or telephone only; no other notice method works. Opting out does not affect warranty coverage. If you keep the product and do not opt out, you accept the arbitration terms.
