In-home repairs and service area - For products that are still in warranty, in-home repairs are provided only if the product is within a 150 km radius of the nearest authorized service center, as determined by LG Canada. - If the product is outside that 150 km radius, you are responsible for bringing the product to the authorized service center at your own expense for in-warranty repair. - Any costs tied to excluded circumstances listed in the warranty’s “This Limited Warranty Does Not Cover” section must be paid by the consumer.

Except where the law prohibits it, all disputes between you and LG that arise from or relate to the limited warranty or the product are to be resolved through binding arbitration, not in a court of general jurisdiction.
The warranty says that, except where prohibited by law, you and LG: - waive the right to a jury trial; and - waive the right to bring or join a class action.
What counts as a dispute For this section, a dispute or claim includes any disagreement of any kind related to: - the sale of the product, - the condition of the product, - the performance of the product, or - the limited warranty itself.
Notice of dispute If you want to start arbitration, you must first give LG written notice at least 30 days before starting arbitration.

Your notice must include: - your name, - your address, - your telephone number, - the product involved, - the nature of the claim, and - the relief you want.
After LG receives the notice, you and LG are expected to try to resolve the claim in good faith. If the dispute is not resolved within 30 days after LG receives the notice, it goes to binding arbitration.
How arbitration works - Arbitration is private and confidential. - It is conducted on a simplified and expedited basis. - A single arbitrator is chosen by the parties under the commercial arbitration law and rules of your province or territory. - You must also send a copy of the written arbitration demand to LG Electronics Canada, Inc., Attn: Legal Department – Arbitration, 20 Norelco Drive, North York, Ontario M9L 2X6. - Judgment on the arbitrator’s award may be entered in any court that has jurisdiction. - The arbitrator decides all issues except questions about whether the arbitration clause applies and whether the dispute can be arbitrated; those questions are for the court.
Governing law and court jurisdiction - The law of the province or territory where you purchased the product governs the limited warranty and any disputes with LG, except where that law conflicts with applicable federal or provincial/territorial law. - If arbitration is not permitted for a claim, dispute, or controversy, you and LG agree to the exclusive jurisdiction of the courts of the province or territory where the product was purchased.
Fees and costs in arbitration - You do not need to pay any fee to begin arbitration. - LG will promptly pay all arbitration filing fees after receiving your written demand, unless you are seeking more than $25,000 in damages; in that case, the applicable arbitration rules control fee payment. - In general, LG pays the filing, administration, and arbitrator fees for arbitration started under the arbitration provision and applicable rules. - If you win, LG will pay your reasonable attorneys’ fees and expenses, considering factors such as the purchase amount and claim amount. - If the arbitrator decides your claim or requested relief is frivolous or brought for an improper purpose, fee payment follows the applicable arbitration rules, and you agree to reimburse LG for amounts LG paid that are otherwise your responsibility. - If LG wins, LG waives any right it may have to seek attorneys’ fees and expenses from you, except as otherwise provided.
Hearings and location - If your claim is $25,000 or less, you may choose one of these options: - document-only arbitration, - a telephone hearing, or - an in-person hearing, as allowed by the arbitration rules. - If your claim is over $25,000, the right to a hearing is determined by the arbitration rules. - In-person hearings are held at the nearest mutually convenient arbitration location in your province or territory, unless you and LG agree to another location or to a telephone arbitration.
Severability and waiver - If part of this limited warranty, including the arbitration procedures, is unenforceable, the rest remains in effect to the fullest extent allowed by law. - If LG does not strictly enforce a provision, that does not mean LG waives that provision.
Opting out of arbitration If you are covered by the binding arbitration provision, you may opt out.
How to opt out You must notify LG no later than 30 calendar days from the date of the first consumer purchaser’s purchase of the product.
You can opt out only by: - emailing optout@lge.com with the subject line “Arbitration Opt Out;” or - calling 1-800-980-2973.
Your opt-out notice must include: - your name and address, - the date the product was purchased, - the product model name or model number, and - the serial number.

What happens if you opt out - If you opt out, neither you nor LG can require the other to participate in arbitration. - The law of the province or territory where you live governs the limited warranty and disputes, except where preempted by or inconsistent with applicable law. - If arbitration is not permitted for a claim or dispute, you and LG agree to the exclusive jurisdiction of the courts of your province or territory of residence. - Opting out does not affect your limited warranty coverage. - If you keep the product and do not opt out, you accept the arbitration terms.
Conflict with the EULA If there is a conflict between this limited warranty and the End User License Agreement (EULA) about dispute resolution, the limited warranty controls and takes priority.
